West Virginia Curfew Laws

WEST VIRGINIA STATE CODE §7-1-12. Authority for establishing county curfews; jurisdiction for violations. In addition to all other powers and duties now conferred by law upon county commissions, such commissions are hereby authorized, by order duly entered of record, to adopt an ordinance which establishes a curfew for persons under eighteen years of age. It shall be unlawful for any person under eighteen years of age to violate any ordinance: Provided, That whenever the county ordinance enacted hereunder conflicts with that of any municipality, the municipal ordinance shall prevail. Any magistrate court, which shall have concurrent jurisdiction with the circuit court, of a county which has enacted an enforceable curfew ordinance may assume jurisdiction of a juvenile charged with violation of such ordinance and make any disposition thereof, which could properly be made by a circuit court exercising its juvenile jurisdiction, except that magistrate courts shall have no jurisdiction to impose a sentence of confinement for the violation of such laws. CHARLESTON, W.Va. — Charleston may keep its teen curfew, the state Supreme Court said in a 4-1 ruling .

Justices acknowledged the ordinance infringes on some parental rights, but said “the impact is too minimal to constitute an unconstitutional infringement upon such rights.”

Under West Virginia law, municipalities are allowed to create curfew ordinances “to protect and promote the public morals, safety, health, welfare and good order,” the court said in an unsigned opinion.Justice Larry Starcher dissented and reserved the right to file a dissenting opinion.

The case stems from a May 1999 decision by a Kanawha County Circuit judge, who upheld the Charleston ordinance placing a curfew on people under 18. The ruling was challenged by three George Washington High School students, a parent and the American Civil Liberties Union, who contended the ordinance was unconstitutional.

Charleston officials refer to the curfew as the “Youth Protection Ordinance.”Minors must be off the streets between 10 p.m. and 6 a.m. on weekdays and between midnight and 6 a.m. on weekends. Teens are allowed to stay out past curfew with their parents’ permission or if they are attending school, cultural or religious outings.

The lawsuit claimed the curfew violated minors’ rights to the pursuit of happiness, due process, equal protection under the law and freedom of speech and assembly.

During a hearing before the high court, Charleston lawyer Jason Huber had argued the ordinance violated parents’ right to raise children, was likely to target minorities, relegated juveniles to second-class citizenship and would not deter crime.
